Implementing Act related to EHDS Article 17

Subject of this implementing act are the requirements for the technical implementation of the rights of natural persons and healthprofessionals listed in artciles 3 up to 18.

EHDS doesn't specify a deadline for the publication of this implementing act, which means the effective deadline is March 2029.

Discussion

Articles 3 to 15 apply to all EHR Systems from 2029 onwards, regardless of whether they are required to support the harmonized EHR components. This means that technical specifications will have to account for the fact that EHR Systems may be using the harmonized components, or that they're using their own exchange functionality and data format in order to satisfy the legal requirements of natural persons.

For access by persons specifications such as the patient request for corrections FHIR IG may serve as a basis for the implementing act.
